Terms & Conditions
- Image Sport reserves the
right to reject any order in whole or in part without
incurring any liability to buyer for such orders as
may be rejected.
- Image Sport reserves the
right to limit credit to be extended hereunder or to
require payment before delivery
- If Image Sport is unable
to manufacture or decides not to manufacture any style
order, Buyer will be notified by Image Sport, but
Image Sport shall not be liable for any non-delivery
of such merchandise. Buyer shall, however accept
delivery and pay for all other merchandise that is
included in that order.
- Buyer will not refuse
any shipment from a carrier unless damage or shortages
are acknowledged and signed by the carrier's driver.
All claims for lost or damaged shipments must be made
directly by Buyer to the delivering carrier at time of
delivery.
- Shortages due to packing
errors must be reported in writing, email, fax, or
phone within 48 hours of receipt to Image Sport.
- Buyer must request for
proof of delivery within 30 days of receipt of
invoice. Otherwise merchandise will be considered
delivered.
- Image Sport will not be
liable for any delay in performance of orders or
contracts, or in delivery of shipment, or for any
damage suffered by Buyer by reason of delay, directly
or indirectly caused by any occurrence force majeure.
- Image Sport reserves
right to discontinue product lines and make changes in
products offered at any time. Check out our website www.imagesport.com/wholesale.html for current line and
availability.
- Image Sport makes no
warranties, express or implied, which extend beyond
the description of the goods on the face of the order.
Without limiting the generality of the foregoing,
Image Sport specifically disclaims any implied
warranty of merchantability or fitness for a
particular purpose and any implied warranty against
claims by third parties for infringement and the like.
- Buyer remedies in the
event of any breach by Image Sport shall be
exclusively limited to return of goods and repayment
of the price.
- In no event shall Buyer
be entitled to claim consequential damages of any
nature, including, but not limited to, loss of
anticipated profits and injury to persons or property.
- This agreement is
governed by the laws of the state of Iowa. The parties
consent to the exclusive jurisdiction of the US
district court for the southern district of Iowa,
central division, and the circuit court of the county
of Dallas, state of Iowa, for all disputes arising under
this agreement.
Order minimums:
- Opening orders will have
$250 minimum
- No Minimum on repeat
orders

Terms:
- Opening orders must be
by Credit Card, COD, or Pre Pay.
- Re Orders can pay by
Credit Card, Pre Pay, COD, Money Order or Certified
and Cashiers Checks.
- Image Sport will accept
Visa, Master Card and AMEX
- Image Sport will
retain your credit card number on file to pay for
each order
- Terms for approved
accounts 2%/10 Net 30
- Application approval
required
- After 30 days 1.5%
monthly service charge on balance applies
Back orders
- All back orders under
$100 will automatically cancel.
Shipping:
- Product shipped by UPS
ground FOB Waukee, IA
- Image Sport will make
every effort to ship in stock product within 48 hours
of receipt of your at once order.
- Deliveries must be made
to a business establishment. Non-business
establishments may incur additional charges and
requirements.
Returns:
- All returns must have
authorization numbers, please call 866.721.4089 for
authorization numbers and instructions.
- Claims for returns must
be made within 48 hours of receiving merchandise.
- No Cash Refunds:
Merchandise replaced or credited to your account.
- All returns must be sent
prepaid.
- There will be a 20%
restocking and shipping and handling fee charged on
all refused orders.
Cancellations:
- Must be made within 15
business days of requested ship date.
- No Cash Refunds: Order
amount credited to your account.
